Welcome to Wiggle Car Hire. These Terms of Service ("Terms") govern your use of our website (wiggle.capetown) and mobile application ("App") operated by Wiggle Car Hire ("Company", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

By accessing and using our website and mobile application, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Wiggle Car Hire provides car rental services through our website and mobile application. Our services include:

3. User Accounts

3.1 Account Creation

To access certain features of our Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password and for all activities that occur under your account. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.

4. Booking and Reservations

4.1 Booking Process

All bookings are subject to availability and confirmation. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

4.2 Payment Terms

Payment is required at the time of booking. We accept various payment methods as displayed on our website and app. All prices are in South African Rand (ZAR) unless otherwise stated.

4.3 Cancellation Policy

Cancellations must be made at least 24 hours before the scheduled pickup time. Late cancellations may incur charges as outlined in our cancellation policy.

5. Vehicle Rental Terms

5.1 Driver Requirements

To rent a vehicle, you must:

  • Be at least 21 years of age
  • Hold a valid driver's license for at least 2 years
  • Provide valid identification
  • Have a clean driving record

5.2 Vehicle Use

Rented vehicles must be used in accordance with South African traffic laws and regulations. Prohibited uses include:

  • Off-road driving
  • Racing or speed testing
  • Transporting hazardous materials
  • Smoking in vehicles
  • Transporting pets without prior approval

5.3 Fuel Policy

Vehicles are provided with a full tank of fuel and must be returned with a full tank. Failure to do so will result in refueling charges.

6. Mobile Application Terms

6.1 App Usage

Our mobile application is available for download on iOS and Android devices. By downloading and using the app, you agree to these Terms and any additional terms specific to the app platform.

6.2 Location Services

The app may request access to your location to provide location-based services such as finding nearby pickup/drop-off points. You can control location permissions through your device settings.

6.3 App Updates

We may update the app from time to time to improve functionality, security, or user experience. Updates may be automatic or require manual installation.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Wiggle Car Hire and its licensors. The Service is protected by copyright, trademark, and other laws.

8. User Content

You may have the opportunity to submit reviews, comments, or other content. By submitting such content, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and distribute such content.

In no event shall Wiggle Car Hire, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless Wiggle Car Hire and its licensors and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.
